No more cars on the sidewalk at Ourisman Volvo

The placement of new cars on the sidewalk outside the Ourisman Volkswagen/Volvo dealership at 7001 Arlington Road has been a topic of consternation for some Bethesda residents. Montgomery County has moved very slowly on the issue, but have now said they will enforce the rules about public space and ADA compliance for the area in front of the apartment building.

If you've gone by in the last few days, you will notice the cars have been removed from the sidewalk. This is Ourisman's second brush with County code violations; the County also declared Ourisman Honda on Bethesda Avenue to have built into the public right-of-way, but chose to ignore the violation after reaching an agreement with Ourisman Honda.

The county did not ignore the violation at the Honda dealer. They negotiated a substantial compromise that forces Ourisman to add a very large brick plaza, with bike racks, seating and landscaping, reduce their customer parking area, and move the existing trail a few feet to the southeast to have additional buffer on the northwest side, and revise the landscaping along the trail. The have to tear down the exposed concrete screen walls and add back a decorative fence and clad their new deck with a decorative aluminum and fiberglass mesh scrim. I believe Ourisman claim that these changes cost them over $1,000,000.00.

I would say this is far from ignoring a violation.

This is regrettable! I enjoyed seeing the latest vehicles parked out front.

I believe the 1,000,000 was to adjust the parking deck to meet the original agreement. The cost of the new agreement is a mere fraction of that. The dealer received a great deal here and that is why Ourisman is so successful.

They have ignored the rules...and start acting like a responsible corp.

This sentence makes no sense and inherently contradicts itself. Did they ignore the violation or did they force Ourisman into a series of concessions? It's one or the other, not both.

The parking deck columns and overhead parking deck, and the concrete screen wall were the items that were built in the easement without approval. Ourisman is not modifying the deck or columns, but did agree to spend about $1,000,000.00 to add the plaza, reduce their parking, repack rhe concrete screen wall with a decorative femnce, move the trail, relandscape around the trail and add scrim to the parking deck. These are not minor modifications.

I suspect the civil engineer that surveyed the property without properly check easements will not be working for Ourisman again, and likely has been sued by Ourisman to recover the extra expense and delays.
