More MoCo Planning Department shenanigans on Marriott HQ project

The agenda for the
Development Review Committee
...until it's not
I have to laugh when I hear the candidates for the Montgomery County Planning Board refer to finding new ways to improve outreach in the planning process. Because I certainly wasn't laughing yesterday morning, when I attempted to exercise my right of public participation in the planning process for the Marriott headquarters and hotel megaproject. The meeting was scheduled to begin at 9:30 AM, gas is not free, and neither is the lowdown dirty set-up of forcing citizens to pay to participate in the planning process, by having metered parking at the planning HQ. When I got there at 9:30, the conference room was dark and empty.

What's going on here? I had double-checked the agenda online before leaving. Not only was there supposed to be a meeting, but Marriott was first on the agenda, as it had been for weeks.

Well, it turns out that a double whammy was pulled.

First, the meeting time was moved back to 10:00 AM. Well, that was just wrong, moving a standard meeting time 30 minutes later. But, wait - there's more! Marriott is now last on the agenda, and will be going on at 11:30 AM. The same time as the Macedonia Baptist Church protest at the Montgomery County Council Building in Rockville, and there's absolutely no question that I am going to be there.

I waited as long as I could, but nope, things dragged out just long enough. As I pulled out of the overpriced parking lot, where I had wasted several dollars parking for nothing, I could see the Marriott team heading toward the building. Whatever information I as a Bethesda resident had a right to learn about the Marriott project, and share with you, my fellow Bethesda residents on this blog, remains top secret. No apologies - if you wasted gas and time driving here for the Marriott review, well, too bad.

That is not an open process.

The department is fully aware of the high interest in this major project. Such a meeting should not be altered in time at the last minute. And it most certainly should not be altered without updating ALL of the agendas posted online. Check out this agenda - it's still online (until they take it down).

While it was stated that Marriott was expected to go overtime - too bad! The Planning Board does the same thing to us, the taxpayers, all the time. They use the parking meters as leverage, in fact. Numerous times, even when there is a big crowd there to testify, they have moved an agenda item to the end. This guarantees your meter is going to run out. Do you run out to put more quarters in, and miss being called to speak? Or just get a ticket? Ridiculous!

Yet, we are often forced to sit there, hour after hour through updates about plans and other irrelevant topics. Why can the developers not sit there, too, if Marriott runs over? Why is there anything else on the agenda with Marriott to begin with, if it is so complicated? The issues for the two projects that took Marriott's place were so minor, it was a waste of those applicants' time to haul them in there yesterday.

Once again, the department shows a shocking lack of respect for the citizens who are making an effort to participate in the process. If there is an important agenda item of great interest to the community, that item should be first, out of courtesy to the residents. And the time of the meeting itself certainly should not be changed.

What is going on here? "Find new ways?" How about respecting the time of the people who pay the salaries and keep the lights on at Planning HQ, and hold the meetings we have now when they are scheduled to be held?

TLDR; Something came up, meeting time changed.

Wow, so much whining and so many inaccuracies:

A) The DRC is not part of the Planning Department
B) Complaining that you had to pay for parking in downtown Silver Spring. Are you serious?
C) All of the plans for Marriott and other projects are available online. Nobody's hiding anything. In any case this is a very informal "Concept Plan." Sketch, preliminary, and site plans can't even be approved until the Sector Plan and Overlay Zone are actually passed.

As a full time working employee during normal work hours, it is amazing that people have the time to show up to these meetings. Props to Robert for being that person who actually has the free time to attend, for all of us who have to work.

10:56 AM Yes, everyone is busy, including Robert. Exactly why they shouldn't totally change meeting agendas without prior notice. Folks don't have all day to wait, so be transparent about time changes. Makes sense to me.

That was one of the sassiest, yet kinda funny, terrible pieces of writing I have read on this blog. I get the point you were going for, good point, absolutely atrocious writing.

"Whatever information I as a Bethesda resident had a right to learn about the Marriott project, and share with you, my fellow Bethesda residents on this blog, remains top secret."

No one else attended?

If Robert is a full time journalist, wouldn't/shouldn't he just suck it up, pay the parking for an extra hour, then whine and bitch after getting the scoop? It sucks, but every job has had this happen before where a client is not fully prepared and it takes longer than necessary. Also, the change may have been very sudden and they did not have time to post notice. I am not saying it was justified, but how do you know it was the council's fault when it could very well have been Mariott's fault? Mariott may have had something come up and had to postpone. That makes more sense as to why they would push it to the end for their sake, not for the council trying to run out people's meters.

Anonymous said...

It's perfectly normal to move the meeting agenda item which is expected to generate the most discussion, towards the end of the agenda. This is done so that people coming for the other items aren't forced to sit through the longer discussion of the main agenda item.

Too bad that Robert Dyer does not have a fellow staff reporter, so that one could have attended the meeting in Silver Spring and the other could attend the meeting in Rockville.

Anonymous said...

I would be Dyer's assistant if he was looking for one. But I don't know what the hourly rate is, or if I would be stuck being an unpaid intern.

Robert can't handle anything. What a cry baby. Time changed. Get over it.

In Robert's defense, it is annoying showing up and being unaware of the time change. Not worth writing a "news" article on, but annoying still.

For those who didn't read the diatribe, so absolute gems below:

"I certainly wasn't laughing yesterday morning, when I attempted to exercise my right of public participation"

"...lowdown dirty set-up of forcing citizens to pay to participate in the planning process, by having metered parking"

"a double whammy was pulled"

"I pulled out of the overpriced parking lot, where I had wasted several dollars parking"

"...Marriott was expected to go overtime - too bad!"

"They use the parking meters as leverage, in fact...This guarantees your meter is going to run out"

"updates about plans and other irrelevant topics"
[Why they would talk about "irrelevant topics" like "plans" at a planning meeting]

Remember, this is someone who wants to run for public office in Montgomery County. He might be surprised to know the electorate here doesn't mirror that which elected the incompetent clown that we have for president (at least until he's impeached this summer).

Anonymous said...

Definitely agree that it is annoying, but Robert's expression of this is ridiculous (AS WITH MOST THINGS).

Robert Dyer said...

A) It absolutely is part of the Planning Department and planning process. The agendas are on the Planning website, and they meet at the Planning headquarters.

B) It's a tax on participation, just like at the Council Building, whether you like it or not.

C) You obviously haven't been to a DRC meeting. Much of what is discussed is not in any document.

I only still come here for the comment section and the simple opening and closings.

1. The Development Review Committee is an inter-agency body that evaluates development applications and approves or revises the proposed design. The Planning Department participates in the DRC, coordinates its work and implements its recommendations. It is entirely reasonable and accurate to criticize the Planning Department for poor scheduling or performance of DRC activities.

2. Yes, schedules occasionally change, but Montgomery County needs to do more, far more, to make the planning and zoning process accessible to residents and taxpayers and to ensure that planning and zoning results reflect the needs and vision of the community. As shown by contentious and disputed planning processes for Westbard, Lyttonsville, Damascus and downtown Bethesda, the process needs an overhaul. I predict that this will be a key issue in the 2018 County elections.

3. Given the erosion of public trust in the planning process, rescheduling public meetings without notice is the wrong thing to do. We need more transparency surrounding MoCo land use planning, not less.

I agree with the point that Dyer is making.

@1:20 pm: Westbard is part of the Bethesda 20816 zip code. You can confirm this by going online and looking up addresses that are part of or adjacent to the Westbard development site (examples: Westbard Shopping Center, the Residences at Capital Crescent Trail, Westwood Towers.)

Nearby neighborhoods, including Springfield, Wood Acres, Westmoreland Hills, Sumner, Glen Echo Heights and Tulip Hill are also part of Bethesda. The incorporated town of Somerset lies to the east of Westbard. Chevy Chase, MD is also east of Westbard, and Chevy Chase, DC is southeast of Westbard.

I'm curious: why doesn't it seem to you that Westbard is part of Bethesda?

@4:34 pm: It's 4:26 pm writing back. I really appreciate your compliment. Thank you.

What I've found in reading this blog is that Robert can get over-heated when he discusses politics or expresses his opinion, but that he's accurate about events/facts (at least the ones that I can personally verify).

FWIW, the Planning Department/Planning Board/County Council permits citizen input on land use issues (we can send written comments or testimony, and give statements for 3 minutes apiece in public hearings), but our views do not appear to be taken seriously. Many people, including myself, are extremely frustrated, and I believe that the Planning Department's/Planning Board's/County Council's handling of land use matters was one of the important elements in the adoption of term limits for the County Council in November 2016. (And it wasn't just a conservative, Republican issue-- you can't get 69% of the vote in MoCo, as term limits did, without Democratic support. FWIW, I vote Democratic.)

For my part, I am grateful to Robert for covering local planning meetings, including issues of controversy. He is the only one to do this consistently in Montgomery County since the Montgomery Gazette closed down in 2014. Bethesda Beat, the blog of Bethesda Magazine, covers some of the same material, but not as regularly as Robert.

@1:20/5:22--
Your question of "what is Bethesda" is really a good one. I had the same question when I moved here. Here's the scoop, with an assist from Wikipedia:

Bethesda is a "census-designated place", that is a place where population is concentrated that does not correspond to a unit of local government. We are a local area defined by the U.S. Census Bureau, and we are also an area defined by zip codes/mailing address, predominantly zip codes 20814, 20816 and 20817. 20814 includes downtown Bethesda. 20816 and 20817 are to the west of 20814 and are more suburban. 20815-- the Chevy Chase zip code/area, is east of Bethesda.

Geographically, Bethesda extends roughly from the DC line to the Capital Beltway on a north-south axis and between Wisconsin Avenue and the Potomac River on an east-west axis. The Westbard's area is southwest of downtown Bethesda. Woodburn is northwest of downtown Bethesda, I believe.

In terms of governance, Bethesda is part of Montgomery County-- the largest county in Maryland (which is always not helpful in getting Bethesda's concerns recognized.)

In summary: Odd as it may seem, Bethesda is a collection of neighborhoods originally defined by the Census Bureau and further delineated by zip codes. We are not a governmental unit. Fortunately, we've done OK despite our amorphous status.

Anonymous said...

@5:10: The Bethesda mailing address includes quite a few zip codes, not just 20814. The largest ones are 20814, 20816 and 20817.

Come on Dyer, I've been to countless zoning, planning, historic review, and other civic meetings in both DC and MD. It's common practice to move agenda items so quicker handled items are completed first out of respect for those people who are actually required to be there. Stop whining and act like you've been there before.

Robert Dyer said...

11:12: It was known from the beginning that Marriott would take time. All the more reason to start on time at 9:30 with Marriott. If they didn't want to, don't put an agenda out with misleading information. Be professional about it. This isn't the high school drama club meeting after school.

Robert Dyer said...

7:07: Those items weren't "handled quicker" - they delayed the start of the meeting 30 minutes.

3:36: This story is the factual account of what happened yesterday. I at no point in the article claimed the meeting was changed because of me. That's your imagination getting the best of you.

My report definitely #triggered the MoCo political cartel. Their troll can be easily distinguished by touting support for the Planning Department's deception and unprofessionalism regarding this meeting, and dismissal of significant gas and parking costs wasted by a taxpaying citizen as a result.

No one, no one, without an ulterior motive and/or financial interest would be criticizing someone for shedding light on a corrupt and unprofessional planning process.

Readers are smart, and capable of realizing this.

Robert Dyer said...

3:00: You're the joke. I've been volunteering for 20 years. You know nothing about me.

You did not post anything on a neighborhood listserv, because you'd be seen as a raving lunatic or developer stooge by all of your neighbors, whose opinions about development and planning align precisely with mine.

You would also be facing a defamation lawsuit for posting false and defamatory statements about me.

I realize your frustration as an impotent Guy Friday for the political machine, but the average resident is squarely in my corner, and wants to know the truth of what's going on in Montgomery County. They're certainly not saluting developers and the Planning Department for a job well done. Just check the results of the term limits vote. Ouch.

Saul Alinsky said...

"dismissal of significant gas and parking costs wasted by a taxpaying citizen as a result."

1) "Dismissal of significant gas" sounds kinda funny. Did you proofread this?

2) How much gas did you waste? Silver Spring is only 4-5 miles from where you live. Maybe you need to get a more fuel-efficient car.

3) How much did you actually spend on parking in Silver Spring?

4) Do you realize that you can deduct mileage and parking costs as a business expense?

5) How much did you pay in taxes?

Robert, county meters have this great technology - parking meter apps! You can auto load your meter while you sit in the meeting fuming and steaming. #2017

Anonymous said...

DYER - Did it ever occur to you that Marriot may have cancelled or rescheduled last minute? That's not uncommon. It's how business takes place sometimes. You haven't worked a traditional job in a while, so that may behoove you to stop with the conspiracy theories (lol @ interfering with your Macedonia temper tantrum).

Robert Dyer said...

5:47: You obviously haven't parked at the planning lot - they're old, metal parking meters. No online payment. #1947

5:06: I don't live in an MPDU.

3:54: What's whiny and immature about a factual account of the failure to conduct the planning process in a professional manner, and with respect towards the taxpayers, the only people in the room who being paid to be there? You literally have no public support for your position.

3:20: Is English your first language? If so, you might have noticed "gas AND parking costs. I realize the construction with "and" could be confusing to a non-native speaker.

I would estimate the whole debacle probably cost me about $6-7.

Do you know how many Councilmembers have released their tax returns? Zero. Nobody has any right to examine a private citizen's tax return, or a public official's, either.

Anonymous said...

I think everyone is missing the main point on this and quick to jump on Robert for this. The church was protesting which Robert had promised to attend, yet the Mariott meeting was moved to the same time. Robert could not be at two places at once, hence why he was fuming and angry . That part does get lost in the writing since Robert stresses more he is anti-parking meter and the system is corrupt, than stressing the moving of the meeting was going to cause him to miss other news.

Robert Dyer said...

6:03: Hard to understand most of that word salad, but I can tell you that it was announced at the meeting that the schedule change was merely because they knew the Marriott review would take longer. They did not say Marriott had anything to do with the decision. But it was know 2 months ago that Marriott would take longer, so changing it at the last second wasn't credible.

This is the second time YOU have claimed a "conspiracy." I made no such claim in my article. There are plenty of other conspiracies in the County. The only way this was a conspiracy was as a conspiracy to make it as difficult as possible for the civilian to participate in the Marriott project review process. I never claimed it was directed at me personally. I don't think anyone knew I was even going to be there. It's the disrespect toward anyone who wanted to attend that I'm criticizing.

What is a "Macedonia temper tantrum?"

Anonymous said...

Robert, even if the meters are old and don't use the app, you can still get up and go re-fill. But the point remains - your anger is likely misdirected at the council. My money is on Marriot moving the time due to a conflict or last minute issue. It stinks but it's normal. What if there had been a time conflict all along? Would you call it an anti-Dyer conspiracy?

Robert Dyer said...

6:10: You're the one who keeps talking about the Council and conspiracy. Neither are mentioned in my article. While I indeed could have refilled the meter yesterday, that wasn't the problem - the problem was changing the time to one beyond which I could remain there.

On the other hand, as I *did* mention in my article, your advice does not apply during a public hearing, because A) you might get called to speak while out at the parking meter, and B) I might miss important testimony I need to quote in my article the next day.

Anonymous said...

Dyer keeps saying he is going to sue for defamation, but he just called someone an impotent Guy Friday. Also, the only reason I would want to see your tax return is you claim you have employed people, you are a CEO, a business man, yet when I used Montgomery County property finder, I do not see you own any property in Montgomery County. Something just does not add up with your story.

Robert Dyer said...

6:15: I don't have to tell you anything about my personal finances or property or anything else. You've run legal and illegal background checks on me, which is just plain weird and creepy. You've established that before.

But you don't sound like much of an expert when you claim that owning a business and hiring people requires you to own property in Montgomery County. You would have to arrest almost every restaurateur in town.

I never said it was illegal to own a business and not live in the county, its more you have claimed to have always lived in the county as a lifelong resident. Hence the assumption you live here. You also have claimed in the past to have employed people and you make a profit. Hence why I would assume you have made money to be able to afford to either own property. If you rent out an apartment that is fine, many people do when just starting out, but you have run for council multiple times and own a business, so I would assume you own property in the county you reside in. I personally have trouble voting for someone who lives in their parents basement their whole life, which maybe you don't and can prove me wrong, but that perception to me just makes me shudder.

Given that you would have arrived no later than 9:15 am and left no later than 11:00 am, and given that parking is $1.00 per hour in the garages in DTSS, that would mean that you spent no more than $1.75.

I'm not shedding any tears for you, Mr. Cheapskate.

10:42am Publishers often have different social channels. Patch had one for every different community it covered.

Makes sense since you can follow the areas that you're interested in.

Robert Dyer said...

10:42: No kidding, dumbass. Unlike the small and slightly-failing magazine, I have different news websites for each area of the county. People in Rockville don't give a damn what's going on in Silver Spring. That's just one of many reasons I am the leading source of hyperlocal news countywide. Plus, people in Rockville don't want to have to wait a week to find out there's a new restaurant opening in the town center, in a reheated version of my article that doesn't cite me as the source. So they read and follow RockvilleNights.com.

10:51: I understand that, as an impotent Guy Friday for the MoCo cartel, you are fine with having a corrupt planning process. Meanwhile, the rest of us are going to speak out about corruption, and vote your guys out in 2018.

Bobby, Bobby, Bobby, there you go again at 2:49PM.

Please tell us how you know @10:51 is"an impotent Guy Friday for the MoCo cartel". Do your "private analytics" reveal to you this information?

Your frequent references to potency, "He-Man", "body slams", "Girly-Man" .etc suggests serious unresolved issues with your own sexuality. Not that there is anything wrong with that.

I am curious why you think you could serve in government having offended: all your likely Council members, the Council President, nearly every County Department, nearly every current elected representative -- MD State House, US Congress - both branches, nearly every State Government Department -- MDOT, several others. The MD Governor.

You would need at least cordial relations with all of these to get anything done as an elected representative for the County.

You have not just shot yourself in the foot in terms of a future role as a representative, you have shot a cannon at your own foot.

4:40: Anyone reduced to trolling my website from a dark room day and night, year after year despite the fact that I continue to publish and grow in success, has been proven impotent. Now you are trying to say I'm gay as an insult, in some kind of passive-aggressive display of homophobia and bigotry. Shocking the kind of lowlifes the MoCo cartel employs.

Anna Van Horn said...

Agreed. That and his instinct to humiliate. Or to say things to others that "he" finds humiliating, assuming others will feel the same way and be shamed.

But, moving on: the MCPS Book Festival is this weekend in Gaithersburg. Nice lineup of authors. Always time well spent.

There is still a puddle of congealed tears next to that parking meter where Robert Dyer sacrificed 7 quarters.

"People in Rockville don't give a damn what's going on in Silver Spring."

And judging by the number of readers for RockvilleNutz, they don't care about what's going on in Rockville, either.

Robert Dyer said...

5:34: I don't know what kind of underground magazine RockvilleNutz is, but I can tell you that Rockville Nights is the most-read source for hyperlocal news in Rockville. You may want to make the switch, so you know what's going on in Rockville.

Anna Van Horn said...

Anna Van Horn said...Robert Dyer deleted. Why? Honest question. How can anyone understand without feedback?

No one is saying you are or aren't gay. It wouldn't matter one way or the other.

What 4:40 is saying is that your insults seem to lean towards the "less of a
man" type taunts.

So either "you" find them insulting or you think "your nemesis" will find them
insulting. Or, possibly, you think it will amuse your readers.

This isn't anything against you, it's just an observation and logic.

Did anyone else see the story about the fourth grader, Samhitha Maramreddy, who will have more political and professional experience than Dyer. This girl gets to be the Mayor of Rockville, why aren't you covering this nice story Robert?

Why are there soo many Md haters from Va trolling on this blog......

Anonymous said...

why do you think we are from VA? I'm from Bethesda all my life. I'm just mad that the author has gotten so deluded and chooses to focus on non Bethesda issues on this blog (Westbard). He should spin Westbard off into its own blog and watch the site go back to peace and good discussion.

@ 8:48 - Seconded.

Looking forward to the spinoff of NiMBYTownNutz.

And MoCoDeadMall, too.

Robert Dyer said...

8:48: Westbard always has been part of Bethesda, dumbass. Check with U.S. Post Office and Census Bureau, if you don't believe me.
